AUTHOR: Jerry Reynolds / Indian Country Today
McCain entered the presidential campaign with considerable standing in
Indian country - not bad for a Republican on overwhelmingly Democratic
turf. But even prior to the rapprochement with Reed, a number of
announcements and positions had compromised his support in some quarters
and led to a re-evaluation in others.

Law->Misc.: U.S. and states should establish Truth and Reconciliation Commissions Posted on Wednesday, July 09 @ 21:52:48 CDT (984 reads)
|

Wahkon writes Truth and reconciliation commissions seek to uncover facts and distinguish truth from lies. The process allows for acknowledgement, appropriate public mourning, forgiveness and healing. And if the US House of Representatives passes their version of Brownback’s apology bill and President Bush signs it Congress should then be pressed to launch a national Truth and Reconciliation Commission. And each state should also debate the need for its own Truth and Reconciliation Commission and then to fund it."

Law->Misc.: Alcohol Prohibition timeline Posted on Wednesday, July 02 @ 04:42:46 CDT (1640 reads)
|

The 1933 appeal of prohibition did not apply to native americans. They continued under prohibition laws until 1953, when President Dwight D. Eisenhower Indian prohibition was repealed country-wide. Indian reservations, however, remained dry unless they opted to permit the possession and sale of alcohol on the reservation.
Many reservations remain "dry" today. However, most frequently, tribal police do not enforce the alcohol law in areas where Anglo federal employees reside, or unless the drinker is causing a disturbance or has committed other crimes.

A threat is now posed by the ''privatize everything'' crowd to divvy up
parts of the Internet and begin charging for faster grades of service and breadth
of access. The freedom-to-access tool we have come to appreciate for the
rapid communications and byway to knowledge it gives us could be changed
forever.

Law->Misc.: Law on books still bans American Indians from Boston Posted on Wednesday, May 18 @ 22:48:39 CDT (4255 reads)
|

John "Sam" Sapiel gets an uneasy feeling when he steps over Boston
city limits. There are no warrants out for his arrest and he hasn't committed
any crime, but he still could be put behind bars -- just because he's an
American Indian.
Sapiel, a 74-year-old full-blooded Penobscot Indian who lives in Falmouth, is
technically a persona non grata in the city of Boston, where an archaic law
forbids American Indians from setting foot since 1675, when settlers were at
war with area tribes.

AUTHOR: Joel Patenaude,

The current U.S. Supreme Court has detoured from more than a century of Indian law jurisprudence by limiting the authority of Indian tribes over their reservations. This was the contention of the many attorneys, judges and academicians gathered at an Indian law conference held in Albuquerque, NM, early last month.
The Rehnquist Court's departure from "settled principles" of Indian law, according to conference speaker David Getches, professor of natural resources law at the University of Colorado School of Law, "inevitably causes confusion among state, local and tribal governments, heightens tensions among Indians and their non-Indian neighbors, undermines reservation economic development efforts, and frustrates lower federal and state courts."
